On November 4, 2024 The Government of Alberta introduced Bill-30 to amend the Condominium Property Act. The bill, if passed, will include several substantial updates to the existing condominium legislation. Key proposed changes include:
The authority to establish a Condominium Dispute Resolution Tribunal;
Allowing chargebacks to be treated as contributions if provided for in a Condominium’s Bylaws;
Clarification as to the amounts that the Condominium can charge back to a Unit;
Requiring developers to pay contributions on Units that are ready for use as soon as the first Unit under that Condominium Plan is transferred to a purchaser;
Changes to voting procedures for ordinary resolutions;
Protections for Board members for actions brought against them personally for actions or omissions undertaken on behalf of the Condominium;
Requiring technical analyses for new condominiums;
Other various clarifications and updates.
Significant details are yet to be released, including specifics on the tribunal’s procedure and matters which it will be empowered to hear. We will provide further updates once they are available.
